Uttarakhand crisis: HC raps Centre, says even President can go wrong

Harish_Rawat_PTI3Nainital: The Uttarakhand High Court came down heavily on the Centre following its submission on Wednesday that courts can’t have jurisdiction over President’s assent while hearing a matter related to imposition of President’s Rule in the Congress-ruled state.
The Uttarakhand High Court, while responding to Centre’s submission, said, ”There is no decision like that of king which can’t be subject to judicial review. That’s essence of Constitution.”

”We are not doubting wisdom of the President, even he can go wrong. Everything is subject to judicial review, you should rejoice at evolution we’ve had,” the high court said.

The bench made these observations while hearing a writ petition of the ousted Chief Minister Harish Rawat’s plea challenging imposition of President’s Rule on March 26.

In a related development, the Supreme Court had on Monday dismissed a PIL challenging the Centre’s decision to impose President’s Rule in Congress-ruled Uttarakhand.

According to ANI, the apex court also rejected demands for CBI probe into alleged horse trading of MLAs in the state.
