Man gets life imprisonment for murdering teenage Indian wife in London
New Delhi: Former Arunachal Pradesh CM Kalikho Pul’s suicide case became a matter of embarrassment for supreme court judges on Tuesday as senior advocate Dushyant Dave questioned the top court judges for converting a complaint into a petition on its own motion and also hearing it.
Dangwimsai Pul, Kalikho Pul’s widow, withdrew her letter to CJI demanding a CBI probe into the allegations made in the suicide note of her late husband.
Pul’s wife has now written to the Vice-President demanding a sanction for the prosecution of the judges mentioned in the note.
The 60-page suicide note contains serious allegations of corruption especially in the highest judiciary of India.
Though the content of a suicide note is not always presumed to be true, but it serves as a dying declaration.
Even the former Governor of Arunachal Pradesh, Raj Khowa, has said that ‘a thorough investigation by the CBI is needed in the case’.
Chief Justice of India, JS Khehar, upon receiving the letter from Pul’s wife demanding a CBI investigation into the case, converted the letter into a criminal writ petition and slotted it for a open court hearing before a bench of Justice UU Lalit and Justice Adarsh Kumar Goel on Thursday.
But senior lawyer Dushyant Dave, who appeared as the counsel for Pul’s wife, informed the bench that the late CM’s wife opposed the conversion of her letter into a petition and stated that the party intends to ‘withdraw the letter from hearing as they don’t want a judicial order’.
Dave submitted that the bench constituted to hear the matter “was not appropriate to deal with the case”.
Dangwimsai Pul’s counsel said that “when CJI is accused in the matter then the court should have dealt with this on the administrative side”.
Dave expressing surprise as to “how this matter was listed in an open court” submitted that the judges should recuse from hearing the case. Dave even said that a former judge of the apex court approached Dave to “influence him in this matter”.
After continuous submission, asking for the letter to be withdrawn, the bench allowed the plea and dismissed the case as withdrawn.
Kalikho Pul was the Chief Minister of Arunachal Pradesh who was unseated on account of a judgment of the Supreme Court, which quashed the imposition of Presidents Rule in Arunachal Pradesh and restored status quo ante.
He committed suicide on 9th August 2016. Following his suicide, a 60 page suicide note/diary was discovered. This note was signed on every page by Kalikho Pul.
