TYTLER CASE- COURT PULLS UP CBI FOR NOT TAKING EFFECTIVE STEPS IN THE INVESTIGATION

Today CBI filed its status report in sealed cover in the Court of Shivali Sharma ACMM, Karkardooma and further asked four months time to be given to complete its investigation.

 

On examination of the report the court found that the investigation conducted by CBI shows that no fruitful/successful steps has been taken by CBI.

 

Mr. Phoolka Senior Advocate appearing for Complainant Lakhwinder Kaur brought to the notice of the Court the order dated 4.12.2015 where the Court rejected the 3rd clean chit given to Jagdish Tytler and gave CBI the lines on which the investigation is to be conducted.

 

Mr. Phoolka argued that out of the 11 points, regarding 5 points the investigation is to be conducted in India only and remaining 6 points the information is available with Canadian High Commission in New Delhi. Mr. Phoolka alleged that in the past CBI collected material only to support the accused Jagdish Tytler and this time also it may not be the same thing.

 

The Court asked CBI about the information of Canadian High Commission, CBI informed the court that CBI had approached Interpol to obtain that information from Canadian high commission. Court pulled up CBI saying that even the letter dated 24.05.2016 written by them to the Canadian High Commission does not shows that the effective steps of investigation has been taken by them. Now the Court has directed CBI to write the Canadian High Commission directly for full information and in case if they are not able to obtain the information they can take the assistance of advocate appearing for complainant.

 

Mr. Phoolka also argued in the court that if CBI can share the letter with him which they have written to the High Commission, he will himself personally follow up with the Canadian government to ensure that the information is provided by the High Commission at the earliest. Mr. Phoolka informed the Court that during his visit to Canada, he visited the office of Canadian Prime Minister to seek their assistance in providing the information. Mr. Phoolka was assured that the Canadian government is serious about the punishment to the guilty of Nov’84 Carnage and will fully cooperate with CBI.

 

The Court has now given 2 months time to CBI to complete the investigation as per the order of 4.12.2015 and submit its report accordingly and fixed next date of hearing 14th September 2016. Court  also directed SP, CBI to appear in the Court if further progress is not made in the investigation.
